Right of Withdrawal
Information for consumers (B2C) and business customers (B2B).
1. Scope
These withdrawal terms apply to contracts for booking shipping services via our website, including the provision of digital documents such as labels, QR codes and invoices.
A consumer is any natural person entering into a legal transaction for purposes predominantly outside their trade, business or profession. A business customer is any natural or legal person, or partnership with legal capacity, acting in the exercise of their commercial or self-employed professional activity.
2. Right of Withdrawal (B2C only)
If you are a consumer (B2C), you have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the date the contract is concluded.
To exercise your right of withdrawal, you must inform us by means of a clear statement: Depha GmbH, Steinriedendamm 15, Halle 1, Eingang 1, 38108 Braunschweig, Germany, Email: info@sendlabel.de, Phone: +49 151 4581 6823. You may use the sample withdrawal form below, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient that you send your communication before the withdrawal period has expired.
3. Effects of Withdrawal (B2C only)
If you withdraw from this contract, we will reimburse all payments received from you without undue delay and no later than fourteen days from the day on which we receive your notice of withdrawal.
We will use the same means of payment that you used for the original transaction unless expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
If you requested that the service begin during the withdrawal period, you must pay an appropriate amount corresponding to the proportion of services already provided up to the time you informed us of your withdrawal.
4. Expiry of the Right of Withdrawal for Digital Services
For service contracts, the right of withdrawal expires if we have fully performed the service and only began performance after you gave your express consent and confirmed your knowledge that you lose your right of withdrawal once the contract has been fully performed.
For digital content not supplied on a tangible medium, the right of withdrawal expires if we began performance after you expressly consented to performance beginning before the end of the withdrawal period and acknowledged that by doing so you lose your right of withdrawal.
5. Notice for Business Customers (B2B)
If you act as a business customer (B2B), there is generally no statutory right of withdrawal. No voluntary right of withdrawal is granted unless expressly agreed in writing.
